Agreement to Our Legal Terms

We are CheckTheCaller ("Company," "we," "us," "our").

We operate the website https://www.checkthecaller.com, as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

CheckTheCaller is a call screening service that protects families from phone scams and AI voice clones. Adult children sign up and set up call forwarding on their parent's phone. Unknown callers are verified before they can ring through. Screened calls and voicemails are viewable in a family dashboard.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and CheckTheCaller, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal Terms. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws.

2. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content"), as well as the trademarks, service marks, and logos (the "Marks").

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content solely for your personal, non-commercial use.

3. User Representations

By using the Services, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use of the Services will not violate any applicable law or regulation.

4. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to: systematically retrieve data without permission; trick or defraud other users; circumvent security features; disparage the Services; harass other users; make improper use of support services; violate applicable laws; upload viruses or harmful material; attempt to impersonate another user; or interfere with the Services.

Additionally, you agree not to set up call screening for another person without their knowledge or legal authority.

5. Services Management

We reserve the right to monitor the Services for violations, take legal action against violators, restrict access, remove excessive content, and otherwise manage the Services to protect our rights and facilitate proper functioning.

6. Subscription and Billing

We offer subscription-based services that automatically renew monthly. We offer a 14-day free trial. At the end of the free trial, the account will not be charged and the subscription will be suspended until upgraded to a paid version. No credit card is required for the free trial.

We accept Visa, Mastercard, American Express, Discover, and PayPal. All payments are in US dollars and processed through Lemon Squeezy. Users may cancel their subscription by logging into their account. Refunds are available upon request.

7. Term and Termination

These Legal Terms remain in full force while you use the Services. We reserve the right to deny access to any person for any reason, including breach of these Legal Terms. We may terminate your account and delete your content at any time without warning.

8. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We cannot guarantee the Services will be available at all times. We have no liability for any loss caused by your inability to access the Services during downtime.

9. Governing Law

These Legal Terms shall be governed by the laws of the State of Delaware, United States. CheckTheCaller and you irrevocably consent that the courts of Delaware shall have exclusive jurisdiction to resolve any dispute.

10. Dispute Resolution

The Parties agree to first attempt to negotiate any Dispute informally for at least 30 days before initiating arbitration. Any unresolved dispute shall be referred to binding arbitration. The seat of arbitration shall be Delaware, United States. The language of the proceedings shall be English. The number of arbitrators shall be 1.

Any arbitration shall be limited to the Dispute between the Parties individually. No class-action arbitration or representative claims are permitted.

11. Limitation of Liability

Our liability to you for any cause whatsoever will at all times be limited to the amount paid by you to us during the six (6) month period prior to any cause of action arising. Users have one (1) year from the date the cause of action arose to bring a claim.

12. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT.

13. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand arising out of your use of the Services, breach of these Legal Terms, violation of third-party rights, or any harmful act toward other users.

14. Industry-Specific Compliance

CheckTheCaller screens and routes telephone calls on behalf of its users using Twilio telecommunications infrastructure. By using this service, you acknowledge that call forwarding, screening, and voicemail recording are subject to the Telephone Consumer Protection Act (TCPA) and applicable state telecommunications laws. CheckTheCaller does not intercept calls without user consent. Users must confirm they have permission or legal authority to set up call screening for another person before activating the service.

15. SMS Communications

By using the Services, you may receive account alert SMS messages from CheckTheCaller. You can opt out at any time by replying STOP to any message.
